Terms of Service

1. Acceptance of Terms

By accessing or using OutageRobot ("the Service"), operated by OutageRobot ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

OutageRobot is an uptime monitoring service that periodically checks the availability of user-specified URLs and attempts to notify users via email when an outage is detected. The Service is provided on an "as is" and "as available" basis.

3. No Guarantee of Notifications

We do not guarantee, warrant, or promise that you will be informed of every outage or downtime event affecting your monitored services. Notification delivery depends on numerous factors beyond our control. Reasons why you may not receive a notification include, but are not limited to:

Our own service may experience outages, maintenance, or technical difficulties that prevent checks from being executed or notifications from being sent. Network connectivity issues, routing problems, or throttling by internet service providers may prevent our monitoring servers from reaching your services or delivering emails. Any mail server, spam filter, or email provider in the delivery chain may delay, quarantine, reject, or silently discard notification emails. Your email inbox may be full, your email address may be invalid, or your email provider may classify our notifications as spam or junk. DNS resolution failures, certificate errors, or other transient technical issues may cause false results. Other unforeseen circumstances, force majeure events, or third-party failures may interfere with the operation of the Service.

You acknowledge and accept that the Service is a best-effort monitoring tool and should not be relied upon as your sole or primary means of detecting outages. We strongly recommend implementing additional, independent monitoring solutions for critical infrastructure.

4. Limitation of Liability

To the fullest extent permitted by applicable law, OutageRobot shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of, or inability to use, the Service. This includes, without limitation, damages for loss of profits, revenue, data, business opportunities, goodwill, or any other intangible losses, even if we have been advised of the possibility of such damages.

We are not liable for any damages, costs, or losses resulting from missed outage notifications, delayed notifications, false positives, false negatives, or any other inaccuracy or failure of the monitoring or notification system.

In no event shall our total aggregate liability to you exceed the amount you have paid us for the Service in the twelve (12) months preceding the event giving rise to the liability, or ten euros (EUR 10.00), whichever is greater.

5. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that the results obtained from using the Service will be accurate or reliable.

6. Service Availability and Modification

We reserve the right, at our sole discretion and at any time, for any reason or no reason, without prior notice and without liability, to:

Modify, update, or discontinue any feature or aspect of the Service, temporarily or permanently. Pause, limit, restrict, or cease the operation of the Service in whole or in part. Change the terms, pricing, or structure of any plan. Impose new limits on the use of the Service, including but not limited to the number of monitored services, check frequency, or notification volume.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

7. Account Termination

We reserve the right to block, suspend, restrict, or permanently delete any user account at any time, for any reason or no reason, at our sole discretion and without any obligation to provide justification, prior notice, or compensation. Reasons for account termination may include, but are not limited to, suspected abuse, violation of these Terms, inactivity, or operational decisions. Upon termination, all data associated with your account, including monitored services, check history, and settings, may be permanently deleted without the possibility of recovery.

8. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Service. You may not use the Service to monitor URLs for which you do not have authorization, to conduct denial-of-service testing, to circumvent rate limits, to distribute malware, or for any other malicious or disruptive purpose.

9. Plans and Advertising

The Service offers different plans with varying features and conditions. By selecting a plan, you agree to the specific conditions of that plan as described during registration or plan change, including any applicable advertising terms. For the Free plan, notification emails may contain advertisements. For the Premium and Premium Plus plans, your email address may be used for advertising purposes as described in our Privacy Policy and as consented to during registration.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal data. By using the Service, you consent to the practices described therein.

11. Indemnification

You agree to indemnify, defend, and hold harmless OutageRobot, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Munich, Germany.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent.
